What Is Probate?

Probate is a word originating from Latin which literally means "proof".  It is the process of proving the Will to the Supreme Court of Queensland to be valid and establishing your right as an Executor to administer the Deceased's Estate.

Why do I Need Probate?

Often Banks or Insurers will refuse to release funds from your loved ones account to the Beneficiaries until such time as a Grant of Probate has been obtained by the Executor.  Probate can also offer an Executor protection from creditors of a deceased estate provided certain criteria are met.  A Grant of Probate can also be used with most Land Titles Offices to transfer real estate to the Executor or Beneficiary.

How Long Does it Take?

You should allow for at least 10 weeks from instructing your Solicitor before a Grant of Probate will be issued to you as there are advertising periods which must elapse before an application to the Supreme Court of Queensland can be made.   Once the Application is made, the usual time frame is around 6 weeks from filing.

Do I need to go to Court?

Fortunately, there is no need!  We will prepare all Court Documents for your execution and file them at the Supreme Court Registry for you.  Personal Attendance is not required and you will be able to sign the Court Documents with a Justice of the Peace local to you.

What do I Need to Get Started?

Before you are able to obtain a Grant of Probate, you will need the original Death Certificate and the Original Will.  If the Original Will is held with another Solicitor we are able to arrange for the transfer of it from their office to ours at no additional cost.  Contact us now and we can provide you with immediate guidance regarding how to get started.
